Terms of sale

1. Purpose

These terms of sale (the “Terms”) govern the sale of the paid options of the Capi app for macOS (the “App”) by NexOps Consulting, EURL with share capital of €1,000, 326 avenue de Cannes, 06580 Pégomas, France, RCS Grasse 992 603 217, VAT FR67992603217 (the “Publisher”), reachable at bonjour@capimac.com. They apply to every order placed on capimac.com by a consumer or a business (“you”).

2. What is sold

The App is free: it is downloaded from capimac.com and used without an account. Two kinds of paid options add to it:

• Capi Pro: “glass of water” and “look far away” reminders, adjustable intervals, the yuzu bath, wardrobe accessories and the ninja outfit.
• Outfit packs (for example the Pirate Pack): an outfit and its signature move, sold separately from Capi Pro.

The exact content of each option is described on capimac.com at the time of the order. The App runs on macOS 13 or later; try the free version before buying to make sure it suits your Mac.

3. Prices

Prices are shown in euros, all taxes included: €7.99 for Capi Pro, €1.99 for the Pirate Pack. Each is a one-time payment, with no subscription or extra fees. Depending on your country, Stripe may offer to charge the equivalent in your currency; the amount charged is the one shown at checkout.

4. Order and payment

Orders are placed from capimac.com or from the App, through a checkout page run by Stripe Payments Europe, Ltd. (Ireland). The Publisher never has access to your card details. The contract is concluded when the payment is confirmed. Stripe sends you a receipt by email.

5. Delivery

The license is delivered right after payment: it appears on the confirmation page and is sent to you by email, with a button to activate it in the App. Activation works offline. If you don't receive anything, write to us and we'll send your license again.

6. License

Your purchase grants you a personal, non-exclusive and non-transferable right to use the option you bought, with no time limit, on the Macs you use. The license is in your name (the email address used for the purchase). You may not resell it, share it publicly or distribute it.

7. Updates

App updates are free and install automatically (this can be turned off in the settings). The Publisher may change the App without removing, for buyers, the features of the option they paid for. A valid license keeps working even if the site or the license service is temporarily unavailable.

8. Right of withdrawal and refunds

You have 14 days from your purchase to change your mind and get a full refund, without giving any reason, even if you have already activated your license. Just write to bonjour@capimac.com from the address used for the purchase, or use the form in the appendix. The refund is made to the original payment method within 14 days of your request. A refunded license must no longer be used.

9. Legal guarantees

You benefit from the legal guarantee of conformity for digital content and services (articles L224-25-1 et seq. of the French Consumer Code) and the guarantee against hidden defects (articles 1641 et seq. of the French Civil Code). If something is wrong, write to us: we'll first try to fix it, and otherwise we'll refund you.

10. Wellbeing, not healthcare

Capi's reminders (break, glass of water, look far away) are inspired by general common-sense recommendations. They are not medical advice and do not replace the advice of a healthcare professional.

11. Liability

The Publisher is bound by an obligation of means. It cannot be held liable for use of the App contrary to its purpose, or for incompatibility with a Mac that does not meet the stated requirements. Nothing in these Terms limits the rights the law guarantees you as a consumer.

12. Personal data

Data related to your purchase is processed as described in the privacy policy.

13. Complaints

For any complaint, write to bonjour@capimac.com. We reply within 7 working days and work with you towards an amicable solution.

14. Governing law

These Terms are governed by French law. If you are a consumer living in another country, you keep the protection of the mandatory rules of your country of residence. Failing an amicable agreement, any dispute will be brought before the competent courts under the ordinary rules.

This English translation is provided for information; the French version prevails.

15. Changes to the Terms

The Publisher may change these Terms. Each order remains governed by the version in force on its date.
